Cryptocurrencies have no legal status. The law does not prohibit cryptocurrencies – they are not classified as legal tender. Austrian law further classifies the mining of crypto assets as "commercial activity" subject to taxation. The Financial Markets Authority (FMA) issued Anti-Money Laundering (AML) regulations in 2020, providing for fines of up to 200,000 euros against cryptocurrency-related businesses that fail to register with the FMA. Austrian law requires that businesses holding crypto assets as business assets must comply with the assessment regulations of the Austrian Income Tax Act.
